Damien and Jessica O’Brien have been charged with second-degree murder, torture and child abuse in connection with the death of their son. Prosecutors allege the parents failed to provide necessary medical care and a safe living environment. The allegations have not yet been proven in court.

A husband and wife are facing multiple felony charges after prosecutors alleged their failure to provide proper medical care and a safe living environment led to the death of their young son.

Damien and Jessica O’Brien have each been charged with second-degree murder, torture and multiple counts of child abuse. According to court documents, the couple’s son weighed approximately 255 pounds at the time of his death and was reportedly unable to walk because of his condition.

Prosecutors allege the parents failed to obtain necessary medical treatment, neglected the child’s basic care and allowed him to remain in unsafe living conditions before his death. Authorities launched an investigation on Nov. 4, 2025, which ultimately resulted in the criminal charges.

The case also involves allegations concerning the couple’s 5-year-old daughter. According to prosecutors, the child was also morbidly obese and was allegedly found outside the family’s home unclothed, dirty and with severely matted hair. Both parents face an additional second-degree child abuse charge related to the girl.

If convicted of second-degree murder, each defendant could face life in prison.

The O’Briens remain presumed innocent unless and until proven guilty in a court of law. Prosecutors must prove every allegation beyond a reasonable doubt during future court proceedings.

The case has drawn national attention and renewed discussion about child neglect, parental responsibility and the importance of seeking timely medical care for children with serious health conditions.
