Committee may determine level of civil and criminal liability for Alabama police by May 2

This week, the Alabama Senate Judiciary Committee is preparing to vote on HB202, a bill proposed by Rep. Rex Reynolds, R-Huntsville, to expand legal immunity for police in Alabama. During a public hearing last week, the bill received praise from Republican leaders as an extension of the “back the blue” bill, but Democratic leaders cautioned that if passed, consequences could be life-threatening for Alabama residents and families.
“Alabama police have a duty to protect the rights and preserve the safety of all people,” said Shelia McNeil, Madison County Democratic Executive Committee (MCDEC) Chair. “Allowing extended immunity to police allows prejudice. It is imperative to stand against this bill and advocate for those susceptible to injustice.”
If accepted as law, Reynolds’ bill would establish police immunity from civil and criminal liability. Police charged with crimes, including accusations of using excessive force that results in injury or death, would be allowed to request a pretrial hearing, where a judge may decide if immunity applies. Prosecution from said crime would be put on hold until the pretrial hearing, within 45 days. The bill is an update to the current law and would be the first change since 1979.
“Alabama police are already well-protected by the law,” McNeil explained. “Unfortunately, it is very difficult to hold officers accountable in some circumstances for actions that appear to violate the law or departmental procedures. We are especially concerned for Black people and other minorities who have been historically victimized by bias and fear. We believe that some police officers may view increased immunity as a ‘green light’ to use excessive force in their encounters.”
