Halle Berry Denies Abuse Allegations as Ex-Husband Seeks Sole Custody

Halle Berry denies child abuse allegations made by ex-husband Olivier Martinez, who is seeking sole custody of their son, Maceo, amid an ongoing court dispute.

Halle Berry is contesting allegations of child abuse made by her ex-husband, Olivier Martinez, as the former couple’s custody dispute returns to court.

Martinez requested sole custody of their son, Maceo, and a domestic violence restraining order following an alleged Sept. 26 incident. According to court documents reviewed by Us Weekly, Martinez claimed Berry physically attacked and choked the child. Berry’s legal team strongly denied his account. 

Berry’s attorney, Marina Beck, described Martinez’s filing as “entirely meritless and deliberately misleading.” Beck also accused him of interfering with their son’s educational and therapeutic services, saying Berry remains focused on supporting Maceo and protecting his best interests.

In subsequent court documents reported by People, Berry denied choking or injuring her son. She described the encounter as playful roughhousing that unexpectedly escalated and said she submitted video evidence and text messages to challenge Martinez’s allegations. She is seeking restoration of their previous equal custody arrangement. 

A judge issued a temporary restraining order and restricted Berry’s visits pending further proceedings. A hearing is scheduled for Oct. 16. The temporary arrangement does not establish that the alleged abuse occurred.

Berry and Martinez married in 2013 and separated in 2015. Their divorce and custody settlement were finalized in 2023, following years of legal proceedings. Their son, described as 12 in the initial filings, has since turned 13.
