WHEREAS, The Estate of Voncille J. Cleary, by Susan Miriam Cleary Sommers, as its Personal Representative; Johanna Lynn Cleary; Susan Miriam Cleary Sommers; Stephen M. Turner and Carrie C. Turner, husband and wife; The Estate of Mary P. Tipton AKA Mary Margaret Tipton, by John Phillip Tipton, as its Personal Representative; Barbie Pogue; Robert Michael Barnes, II and Anna Grace Watkins Barnes; Grassy Pond, L.P., by John W. Hays as the President of Grassy Pond, Inc., as its General Partner; Deposit Road, LLC, an Alabama Limited Company, by James R. Hays and John W. Hays, as its Management Committee Managers; Enfinger Development, LLC, by Jeffrey W. Enfinger as its sole Member and Manager, being the owners, as the term is defined by Section 11-42-20, Code of Alabama 1975, of all the property or territory hereinafter particularly described (which property or territory is hereinafter referred to as “the Property”), filed with the City Clerk of the City of Huntsville, Alabama, a signed and written petition requesting that the Property be annexed to the City of Huntsville, Alabama, which petition is on file with the City Clerk of the City of Huntsville, Alabama; and
